The number of election petitions has more than doubled in recent years. Indeed, between October 1, 2023 and September 30, 2024, the NLRB received 3,286 union election petitions, up 27% since FY 2023. That’s more than double the number of petitions received since FY 2021.
There is also a rise in unfair labor practice charges (ULPs). The number of ULPs from FY 2023 to FY 2024 increased 7%. According to the NLRB, it received its highest total case intake in over a decade. 😲
So why the resurgence❓
Unions are in a renaissance period, at least when it comes to media attention. High-profile cases from Starbucks ☕️, United Auto Workers 🚘, Apple 🍏, and Trader Joe’s 🛒 have thrust unions, and the NLRB, back into the public spotlight.
Also, the NLRB’s General Counsel has made multiple headlines with her positions on non-compete agreements, settlement agreements, and pay-or-stay provisions.
It’s difficult to predict whether the numbers will continue to rise in 2025.
That said, employers shouldpay attention, especially employers with a non-union workforce. It’s never been easier for works to organize.
